  • Provide accurate and complete information during the engagement process.
  • Comply with all applicable laws and regulations.
  • Avoid using our services for unlawful or unauthorized purposes, including fraud, data theft, or any activity harmful to third parties.

Failure to adhere to these obligations may result in the suspension or termination of services.

4. Payment Terms

  • All payments must be made as per the agreed-upon terms outlined in individual service contracts.
  • Services will commence only after receiving the advance payment specified in the agreement.
  • Late payments may incur penalties or delays in project timelines.

5. No Refund Policy

Due to the custom nature of our deliverables, no refunds are offered once a project has commenced. For more information, refer to our Refund Policy.

6. Intellectual Property

  • All deliverables, including software, code, designs, and digital assets, remain the intellectual property of Scaled Holdings India Private Limited until full payment is received.
  • After payment, ownership rights will be transferred to the client as per the agreement, excluding third-party software licenses or pre-existing proprietary materials.
  • Unauthorized reproduction, modification, or distribution of our intellectual property is strictly prohibited.

7. Confidentiality

We respect the confidentiality of your information. Both parties agree to:

  • Keep proprietary information, trade secrets, and project details confidential.
  • Not disclose such information to third parties without written consent.

This confidentiality agreement remains in effect even after the termination of services.

8. Limitation of Liability

We are not liable for:

  • Any indirect, incidental, or consequential damages arising from the use of our services.
  • Delays or disruptions caused by third-party service providers or force majeure events.
  • Errors or omissions in information or content provided by the client.

Our total liability under these Terms shall not exceed the total amount paid by you for the specific service.

9. Termination

We reserve the right to suspend or terminate services if:

  • You breach these Terms or any applicable laws.
  • Payments are overdue beyond the agreed timeframe.

You may terminate the service agreement by providing written notice as per the terms outlined in the contract.

10. Dispute Resolution

For any disputes arising from these Terms:

  • You agree to contact us first at hey@scaled.co.in to resolve the issue amicably.
  • Unresolved disputes may be subject to arbitration under the Indian Arbitration and Conciliation Act, 1996.
  • The jurisdiction for disputes shall be Srinagar, Jammu & Kashmir, India.

11. Third-Party Tools and Services

We may integrate third-party tools, plugins, or software into our deliverables. You acknowledge that:

  • Use of third-party services is subject to their respective terms and conditions.
  • We are not liable for issues arising from third-party integrations.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India.
